KUALA LUMPUR: A seminar on Syariah Law review wants non-Muslims found committing khalwat (close proximity) with Muslims to also be held liable.
This was among the proposals made at the two-day seminar organised by the Islamic Institute of Understanding Malaysia (Ikim) and the Syariah Judiciary Department Malaysia.
Syariah Court of Appeal Judge Datuk Mohd Asri Abdullah said the seminar had proposed that non-Muslims committing khalwat with Muslims should also be sentenced accordingly, but in the civil courts.
“We don’t have the jurisdiction to sentence non-Muslims committing khalwat with Muslims,” he told reporters after closing the seminar on behalf of department director-general Datuk Ibrahim Lembut at Ikim here today.
“The Muslims can be sentenced in Syariah courts, and the non-Muslim partners can probably be sentenced in the civil courts, to be fair to both parties.”
He said the proposal, contained in a draft resolution at the seminar, would be forwarded to the Attorney-General’s Chambers.
“It is up to the Attorney-General’s Chambers or the relevant authorities to decide how to create such a law,” he said.
However, he declined to elaborate when the proposal would be forwarded to the Government.

Despite of religious belief, I think if a couple decided to go ahead and commit ‘khalwat’ will do so anyhow. It doesn’t make much difference though.

This is the 2nd most ridiculous thing I have heard since post election. Firstly, it was the proposal for implementation of the Hudud law in one of the states that is held by the opposition..and now it is being proposed that Non-Muslims will be prosecuted for khalwat charges?
They actually do have the doctrine to implement that following the Federal Constitution Article 11(1)(4)
Art 11(1) Every person has the right to profess and practice his religion and, subject to Clause (4), to propagate it.
(2) No person shall be compelled to pay any tax the proceeds of which are specially allocated in whole or in part for the purposes of a religion other than his own.
(3) Every religious group has the right -
(a) to manage its own religious affairs;
(b) to establish and maintain institutions for religious or charitable purposes; and
(c) to acquire and own property and hold and administer it in accordance with law.
(4) State law and in respect of the Federal Territories of Kuala Lumpur and Lubuan, federal law may control or restrict the propagation of any religious doctrine or belief among persons professing the religion of Islam.

I personally feel its just plain out ridiculous. If a Muslim would want to be with a Non-Muslim and they want to be in close proximity, the couple should and already knows the consequences for the Muslim partner following their doing (in case of any *touch wood* raiding).
I am all for individuality rights–as long as i do not bother other people’s peace and lives, I’m all good…i AM responsible for my own actions. We do NOT need laws to tell us to do so.
